PUBLIC RECORDS REQUEST PROCEDURES

  • Payment is due in advance for all requests for public records.  If the records requested are to be mailed, the requestor is responsible for all applicable postage fees.  Postage amount is based upon the weight and size of the mailing and be charged separately.  Checks must be made payable to the Indian River County Supervisor of Elections.
  • Please consider using the electronic form on our website to simplify making your public records request. You are not required to submit your request in writing, provide your identity, the purpose or an explanation for seeking records.  The information fields below indicated on the electronic form are not required per Florida law, Chapter 119 Florida Statutes, however, if you make a public records request using the online form, please provide a method of contact.
  • If the requestor chooses not to give their contact information, staff will assign a file number.  The requestor is given their file number and advised to follow up in order to make arrangements to pick up the requested information when the order has been processed.  The requester is responsible for following up to ensure their request is received.
  • A public records request received via postal mail will be time and date stamped and the envelope will be retained.  Faxed requests will be time and date stamped upon receipt.  E-mailed requests will receive a response from the Supervisor of Elections indicating receipt of the request.  If payment is not received with the request, staff will contact the requestor and request payment.  The public records request will not be processed until payment is received.
  • EXEMPTIONS: Florida Statutes have established that certain information is exempt from public record.  When necessary, exempt information will be redacted in order to process a request.  A document with exempt information will be copied, the exempt information blacked out and then a copy of the document with the redaction will be provided to the requester.  The original record will be re-filed. Surveillance videos are exempt from public disclosure under F.S. 119.071(3)(a)1 and also under all the CISA exemptions.
  • Inspection of records will take place during normal business hours.  Appointments will be made by the Supervisor of Elections after advising the requester when the records will be available.  The Supervisor of Elections will designate a staff member to remain with the records to supervise their inspection. SOE staff are the only persons who are allowed by law to touch these records.  Extensive use charges will apply for any inspections that are longer than 15 minutes and must be paid in advance.
  • If a fee is collected, a receipt will be provided to the requestor indicating method of payment.  Checks must be made payable to the Indian River County Supervisor of Elections.  The requestor is responsible to pay the returned check fees on any returned checks.
